By creating an account, purchasing a subscription, or continuing to use the service, you accept these terms and enter into a contract with Dizabyte. If you are contracting on behalf of an organization, you represent that you have the authority to bind it. If you do not agree, do not use the service.

2. Authorized reseller (Merchant of Record)

Nuestro proceso de pedido lo gestiona nuestro revendedor en línea Paddle.com. Paddle.com es el Merchant of Record (vendedor autorizado) de todos nuestros pedidos. Paddle atiende todas las consultas de atención al cliente y gestiona las devoluciones.

Paddle.com Market Ltd handles payment, billing, and applicable taxes, and will appear as the charge on your bank statement. Payment, renewal, tax, cancellation, and refund conditions are also governed by Paddle's Buyer Terms and its refund policy.

3. The service

netclariq is a web application for recording and analyzing personal and family financial information: accounts, transactions, budgets, debts, investments, taxation, and projections. It is offered "as is", with a free plan and paid plans that include additional features.

The content of the service, including reports, simulations, tax calculations, and responses from the artificial intelligence assistant, is purely informational and does not constitute financial, investment, tax, accounting, or legal advice nor a recommendation to buy or sell any product. Results depend on the data you enter and on external sources that may contain errors or delays. You must verify the information before making decisions, which are your sole responsibility.

4. Accounts and security

You must be of legal age and provide truthful and up-to-date information. You are responsible for keeping your credentials confidential and for any activity carried out from your account. Notify us immediately of any unauthorized use.

5. Acceptable use

You may not:

  • Use the service for unlawful or fraudulent purposes, for spam, or in a way that infringes third-party rights.
  • Attempt to access other users' data, breach security measures, introduce malicious code, or carry out unauthorized penetration testing.
  • Interfere with the operation of the service, overload it, or perform massive automated data extraction.
  • Resell, sublicense, redistribute, decompile, or reverse engineer the service, or circumvent its technical or plan limits.
  • Upload third-party information without a legitimate basis for processing it, or use the assistant to generate unlawful content.

6. Subscriptions and renewal

Paid plans are billed in advance on a monthly or annual basis and renew automatically at the end of each period until you cancel. The applicable price is the one shown on the pricing page at the time of purchase.

Price changes. Dizabyte may revise the rates for the Pro and Family plans. If a price change occurs, we will notify you at least 30 calendar days before the new amount applies to your next renewal. The price in effect when you subscribed will be honored until the end of the period already paid. If you disagree with the new rate, you may cancel your subscription before renewal and will keep access until the end of the contracted period.

You can cancel at any time from the subscription page. Cancellation takes effect at the end of the period already paid, and you keep access until that date. If a payment fails, we will maintain access during a grace period while the charge is retried. Refunds and the right of withdrawal are governed by our cancellation and refund policy.

7. Free plan and adjustment of limits

The Free Plan is offered at no cost and may include limits on the number of accounts, transactions, browsable history, active modules, or advanced features. Dizabyte reserves the right to modify, expand, or reduce the limits and features of the Free Plan, as well as to move free features to paid plans, giving reasonable advance notice of substantial changes.

Continued use of the Free Plan after such adjustments are published implies acceptance of the new limits. No right to financial compensation arises, nor to indefinitely maintain features that are no longer part of the Free Plan. Before any significant transition, you will be able to export your data from your profile.

8. Intellectual property

The software, brand, design, and documentation are owned by us or our licensors and are protected by intellectual property law. We grant you a limited, personal, revocable, non-exclusive, and non-transferable license to use the service within your contracted plan and in accordance with these terms.

Your data is yours. You retain all rights to the information you enter, and you grant us only the license needed to host and process it in order to provide the service, in accordance with the privacy policy. If you believe any content infringes your rights, write to us at info@dizabyte.es and we will remove it where appropriate.

9. Suspension and termination

We may suspend or cancel your account, with prior notice when reasonably possible, in the event of material breach of these terms, non-payment, security risk or fraud, or repeated or serious infringements. You can close your account at any time from your profile.

Consequences of termination: before deleting your account you can export all your data as JSON or CSV from your profile. After deletion, data is removed or anonymized in accordance with the privacy policy, except for data we must retain due to legal obligations.

10. Availability and warranties

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation, nor the accuracy of market prices or other data obtained from third parties. To the extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose. We may perform maintenance and modify features to improve the product.

11. Liability

To the extent permitted by law, our total liability is limited to the amount paid for the service in the twelve months preceding the event giving rise to it. We are not liable for indirect or consequential damages, loss of profits, loss of data or goodwill, nor for investment, tax, or credit decisions made based on the information provided by the service.

Nothing herein excludes liability for willful misconduct, fraud, death, or personal injury, nor limits the rights that consumer protection law imperatively grants to the user.

12. Indemnification

You will hold us harmless against third-party claims arising from content you enter, unlawful use of the service, or breach of these terms, including reasonable defense costs.

13. Assignment and force majeure

You may not assign your contract without our written consent. We may assign it in the event of a merger, acquisition, or sale of assets, without affecting your rights. Neither party will be liable for failures due to causes beyond its reasonable control (infrastructure provider failures, network outages, disasters, or acts of authority).

14. Changes to these terms

We may update these terms. We will publish the new version with its date and, if the change is substantial, notify you by email or within the application before it takes effect.

15. Governing law and dispute resolution

These terms are governed by the law of Spain, without prejudice to the mandatory consumer protection rules of the user's country of residence. Before going to court, we ask that you write to us at info@dizabyte.es so we can try to reach an amicable solution. Consumers may also go to the courts of their domicile and to the alternative dispute resolution mechanisms available in the European Union.
